Czech Republic

The Czech Republic regularly reports hate crime data to ODIHR. The Czech Republic's hate crime laws consist of a combination of general and specific penalty-enhancement provisions and substantive offences. The data reported to ODIHR combine hate crime and hate speech. Hate crime data are collected by the Informatics and Analytical Centre of the Criminal Police and the Investigation Service of the Police Presidium, the Analytical and Legislative Department of the Supreme Public Prosecutor's Office and the Informatics Department of the Ministry of Justice. Hate crime data are published annually by the government in a Report on extremism.

About 2020 Data

    The authorities monitored and reported on 134 "offences with a hostility background", a category that includes criminal forms of intolerance other than hate crimes. While the numbers presented here only represent hate crimes according to the OSCE definition, the breakdown by bias motivation below is based on these offences. The reported number of prosecuted hate crimes represents the number of people charged. The sentencing figure represents the number of people convicted, some of whom may have committed more than one hate crime.

The breakdown below includes records of crimes with respect to three specific bias motivations: anti-Semitic hate crimes; anti-Roma hate crimes; and anti-Muslim hate crimes. Records of crimes based on 56 other bias motivations were not reported.

National developments

In 2020, the Ministry of Justice continued to financially support the NGO "In Iustitia", in particular its work supporting to victims of hate crimes. The funding is based on Law no. 45/2013 Coll. on victims of crime which transposed the EU "Victims Directive" (Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012 establishing minimum standards on the rights, support, and protection of victims of crime, and replacing the Council Framework Decision 2001/220/JHA).

The Ministry of Justice's Institute for Criminology and Social Prevention further conducted a research project entitled "Criminological Analysis of Hate Crimes" which addresses the social and psychological backgrounds of perpetrators committing hate crimes motivated by racist, ethnic, religious, and other similar forms of bias.

Racist and xenophobic hate crime

The Council of Europe Committee of Ministers published relevant recommendations in its "Resolution on the Implementation of the Framework Convention for the protection of National Minorities by the Czech Republic".

Racist and xenophobic hate crime, Anti-Roma hate crime

The United Nations Committee on the Rights of the Child (CRC) published relevant recommendations in its "Concluding observations on the combined fifth and sixth periodic reports of Czechia".

KEY OBSERVATION

ODIHR recognizes the Czech Republic's efforts to build prosecutors' capacities in addressing hate crimes. However, based on the available information, it observes that its hate crime recording and statistics do not sufficiently distinguish hate crimes from other crimes. In addition, ODIHR observes that the Czech Republic would benefit from raising the awareness and building the capacity of police about hate crimes.

ODIHR recalls that in the Ministerial Council Decision 9/09, participating States have agreed to a definition of hate crime shared by all OSCE participating States. They have also committed to collecting reliable data and statistics on hate crimes. To that end, hate crimes need to be distinguished throughout the recording and data collection process from crimes of incitement to hatred and other hate speech offences. In the Ministerial Council Decision 9/09, participating States have also committed to introducing or further developing professional training and capacity-building activities for law-enforcement, prosecution, and judicial officials dealing with hate crimes. ODIHR stands ready to support the Czech Republic in meeting its relevant commitments through the provision of comprehensive resources and tailored assistance in the area of hate crime recording and data collection, as well as further resources and tailored capacity building assistance for police.
