Police records include criminal offences that may fall outside of the OSCE's definition of a hate crime. The data do not include data from the Federal Police Administration. In some cases, hate speech provisions were also applied to incidents that would fall under this definition. One incident involved two separate criminal offences and is, therefore, counted twice under the police records.

ODIHR Recommendations

ODIHR recognizes Bosnia and Herzegovina's efforts in reporting information on hate crime to ODIHR. However, based on the available information, it observes the low numbers of officially recorded hate crimes. In addition, ODIHR observes that Bosnia and Herzegovina would benefit from raising awareness and building the capacity of criminal justice officials to address hate crimes.

ODIHR recalls that in the Ministerial Council Decisions 9/09 and 12/04, participating States have committed to collecting reliable data and statistics, taking- appropriate measures to encourage victims to report hate crimes, including through cooperation with civil society, and to make use of all reliable information available. To that end, a robust system for hate crime recording initiatives to encourage victims to report must be introduced. ODIHR recalls that in the Ministerial Council Decision 9/09, participating States have committed to introducing or further developing professional training and capacity-building activities for law-enforcement, prosecution and judicial officials dealing with hate crimes. ODIHR stands ready to support Bosnia and Herzegovina in meeting the relevant commitments through the provision of comprehensive resources and tailored assistance in the area of hate crime recording and data collection, as well as providing further resources and tailored capacity building assistance for police, prosecution, and judiciary.
