Section 81 No. 6
In determining the penalty it shall, as a general rule, be considered an aggravating circumstance that
(...)
6) the offence fully or partly stem from others’ ethnical origins, religious beliefs, handicap, sexual orientation gender identity, gender expression or sex characteristics or similar;

Section 81 f. 
The prescribed penalty may be increased by up to half if the offense is wholly or partly motivated by the ethnic origin, beliefs, disability, sexual orientation, gender identity, gender expression, sex characteristics, or similar traits of others, and the offense is committed within an enhanced penalty zone designated pursuant to section 6 a(1), third sentence, of the Police Activities Act or during an enhanced penalty period established pursuant to section 6 f(1) of the Police Activities Act.
