The Criminal Code of the Republic of Belarus

Article 64. Aggravating circumstances

1.  Aggravating circumstances are recognized as:

(9) a crime motivated by racial, national or religious hatred or discord, political or ideological enmity, as well as hatred or hostility towards any social group;

Article 130. Incitement to racial, national or religious hatred or discord

1. Deliberate actions aimed at incitement to racial, national or religious hatred or discord, humiliation of national honour and dignity, shall be punished by a fine or arrest for up to six months, or restraint of liberty for up to five years, or imprisonment for the same term.

2. The same actions, combined with violence or committed by an official using his/her authority, are punishable by imprisonment for a term of three to ten years.
3. The actions referred to in the first or second paragraph of this article, committed by a group of persons or caused human death or other grave consequences by negligence shall be punished by imprisonment for a term of five to twelve years.

Article 139 Murder

1. Intentional wrongful deprivation of life of another person (murder) shall be punished by imprisonment for a term of six to fifteen years.

2. Murder:

14) motivated by racial, national or religious hatred or discord, political or ideological enmity, as well as hatred or discord towards any social group;
(...)
shall be punished by imprisonment for a term of eight to twenty-five years, or life imprisonment, or the death penalty...

 

Article 147. Intentional infliction of serious bodily injury

1. Intentional infliction of serious bodily injury, namely, damage that is life-threatening or resulted in the loss of sight, speech, hearing, any other organ or loss of organ’s functions , interruption of pregnancy, mental illness (disease), other health disorder, coupled with permanent loss of capacity to work on at least one-third, or caused the health problem associated with the trauma of bones, on more than four months, or expressed in indelible disfigurement of the face or neck, is punishable by restraint of liberty for a term of three to five years, or imprisonment for a term of four to eight years.
2. The same act if committed:

8) motivated by racial, ethnic or religious hatred or discord, political or ideological enmity, as well as hatred or discord towards any social group;

(...)
shall be punished by imprisonment for a term of five to fifteen years.
