Украина регулярно предоставляет БДИПЧ данные о преступлениях на почве ненависти. В 2019 году Национальная полиция Украины и Министерство внутренних дел совместно с БДИПЧ опубликовали информационный буклет Категоризация и расследование преступлений на почве ненависти в Украине: Практическое руководство. Национальная стратегия Украины в области прав человека включает задачу "создать систему предупреждения, пресечения, документирования и расследования преступлений на почве ненависти". В 2020 году была создана рабочая группа, координируемая Уполномоченным по правам человека в украинском парламенте, для улучшения процедур регистрации преступлений на почве ненависти.

Hate crime recorded by police

National developments

In 2023, the National Police of Ukraine organized and held a series of trainings, webinars, conferences, roundtables and other events aimed at preventing and responding to unlawful actions committed on the grounds of racial, national, or religious hatred, or on the grounds of sexual orientation, disability and other characteristics, and at ensuring human rights and freedoms. In particular, the National Police organized the following events with the support of public and international organizations:

  • a three-day event for employees of the Human Rights Division of the Inspectorate General in Ukraine to establish co-operation and improve efforts to prevent and respond to hate crimes in Ukraine (held with the support of the NGO "Gender Stream");
  • an online seminar on "General principles of gender equality and the formation of zero tolerance for gender-based violence and discrimination";
  • a series of online webinars covering the basic concepts of gender equality and discrimination;
  • a series of training events on identifying, responding to and documenting conflict-related sexual violence through a victim-centred approach;
  • a training of trainers on the topic of "Gender equality and the prohibition of discrimination through the prism of Article 14 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Protocol 12 to the Convention"; and
  • a training event on combating discrimination and hate speech against vulnerable groups.

The National Police also co-operated with the Council of Europe (CoE) to organize a series of CoE and European Union-funded roundtables as part of the CoE project on "Supporting the implementation of European standards on combating discrimination and the rights of national minorities in Ukraine". The initiative included a visit of Ukrainian police officers to Poland, where they participated in a conference on "Ensuring the implementation of reforms in the field of combating discrimination in Ukraine". The event examined the work of the National Police of Ukraine and the results of the anti-discrimination reforms, culminating in proposals for further co-operation and agreements to tackle discrimination.

In 2023, a training course on addressing discrimination and hate speech was held as part of European Union and Council of Europe projects on combating hate speech and strengthening social protection in Ukraine.

In October 2023, employees of the National Police of Ukraine participated in a training course on "Policing in Diverse Societies" in Strasbourg, France, which looked at the role of law enforcement and civil society in combating racism. Participation in the training course was funded by the European Union and CoE as part of projects on combating racism and promoting equality and non-discrimination (the Horizontal Fund for the Western Balkans and Turkey III, 2023-2026).

Employees of the Department of the General Inspection and Human Rights of the National Police of Ukraine also took part in an online exchange of experiences with the Head of Portugal's Department of Public Prevention and Interaction with the Population (Public Security Police of Portugal). During the meeting, they discussed Portugal's best practices in preventing discrimination and promoting equality and diversity.

KEY OBSERVATION

ODIHR recognizes Ukraine's efforts to report its hate crime information to ODIHR. In the absence of official statistics, ODIHR is not able to provide further observations on hate crime data collection in Ukraine. In addition, ODIHR observes that Ukraine would benefit from raising awareness among and building the capacity of criminal justice officials to address hate crime.

ODIHR recalls that in Ministerial Council Decision 9/09, participating States committed to periodically report reliable information and statistics on hate crime to ODIHR. Participating States also committed to introducing or further developing professional training and capacity-building activities for law enforcement, prosecution and judicial officials dealing with hate crimes. ODIHR stands ready to support Ukraine in meeting its relevant commitments through the provision of comprehensive resources and tailored assistance in the area of hate crime recording and data collection, as well as further resources and tailored capacity building assistance for police, prosecution, and judiciary.
