Сербия регулярно предоставляет БДИПЧ данные о преступлениях на почве ненависти. В 2018 году Генеральная прокуратура при поддержке Миссии ОБСЕ в Сербии и БДИПЧ разработала Руководство по уголовному преследованию по делам о преступлениях на почве ненависти в Республике Сербия. Была создана сеть контактных лиц, занимающихся вопросами преступлений на почве ненависти в органах прокуратуры, и при содействии Миссии ОБСЕ Судебная академия разработала и интегрировала план и программу обучения по вопросам преступлений на почве ненависти.

Most records reported by the police, the prosecution services, and the sentencing figures include the offences of incitement to hatred, defamation, and discrimination or violation of equality, all of which fall outside of the OSCE's definition of hate crime.

KEY OBSERVATION
ODIHR recognizes Serbia's efforts to prosecute hate crimes effectively and to regularly report hate crime data to ODIHR. However, based on the available information, it observes that Serbia does not collect data and statistics on hate crimes. In addition, ODIHR observes that Serbia would benefit from raising awareness among and building the capacity of police to address hate crime.
ODIHR recalls that in Ministerial Council Decision 9/09, OSCE participating States committed to collecting reliable data and statistics on hate crimes. Participating States also committed to introducing or further developing professional training and capacity-building activities for law enforcement, prosecution, and judicial officials dealing with hate crimes. ODIHR stands ready to support Serbia in meeting its relevant commitments through the provision of comprehensive resources and tailored assistance in the area of hate crime reporting, as well as by providing further resources and tailored capacity building assistance for police, prosecution, and judiciary.
