ODIHR Recommendations

ODIHR recognizes Azerbaijan's efforts to report hate crime information and data to ODIHR. However, based on the available information, it observes that Azerbaijan's hate crime recording and statistics do not sufficiently distinguish hate crimes from other crimes. In addition, ODIHR observes that Azerbaijan would benefit from reviewing the existing legal framework in order to ensure that bias motivation can be effectively acknowledged and appropriate penalties imposed on the perpetrators.

ODIHR recalls that in Ministerial Council Decision 9/09, OSCE participating States committed to collecting reliable data and statistics on hate crimes. Participating States also committed to enact specific, tailored legislation to combat hate crimes, providing for effective penalties that take into account the gravity of such crimes. ODIHR stands ready to support Azerbaijan in meeting the relevant commitments through the provision of comprehensive resources and tailored assistance in the area of hate crime recording and data collection, as well as in meeting the relevant commitments through further resources its tailored legislative advice.

Overall incidents summary

The assessment of incidents reported by ODIHR is without prejudice to the applicability and relevance of other branches of public international law, particularly international humanitarian law and international criminal law. In addition to the hate incidents displayed on Azerbaijan's country page, ODIHR received information on a number of hate incidents that were not included as they go beyond the scope of ODIHR's Hate Crime Report.
